Acceptable Use Policy


This Acceptance Use Policy is used in conjunction with terms and conditions of our Service Agreement. Customers who does not agree to be bound by these should immediately stop use of TACare Services (Asia) Pte Ltd and notify our management so that their services can be terminated. We reserve the right, at our discretion, to update or revise this policy, any other policy or statement on any TACare Services (Asia) Pte Ltd website, and any product or programs described on our website.


TACare Services (Asia) Pte Ltd (known here as "TACare") Acceptable Use Policy has been developed with the following objectives:

• Preserve the privacy and security of individual users.

• Preserve the value of Internet resources as a conduit for free expression

• Encourage the responsible use of net resources and discourage practices which degrade the usability of network resources and thus the value of

   Internet services.

• Ensure security, reliability and privacy of TACare systems and network, and the networks and systems of others.

• Avoid situations that may cause TACare to incur civil liability.

• We respect our Customers to use the Internet with courtesy and responsibility and to be familiar

  with and to practice good Internet etiquette.By adhering to the following policies, our Customers are protecting the rights and privileges of all Internet

  users


VIOLATION OF ANY OF THE FOLLOWING POLICIES IS STRICTLY PROHIBITED AND WILL RESULT IN IMMEDIATE TERMINATION OF ALL ACCOUNTS AND MAY INCUR FINANCIAL PENALTIES TO THE VIOLATOR.

LAWFUL USE

You must use this site and the TACare Services in accordance with the terms of this policy and your TACare Service Agreement, and in accordance with all federal, state and local laws, ordinances, and regulations.

UNLAWFUL USE

Use of this site or TACare Services for any purpose that is unlawful or in any manner which could harm or impair this site, TACare network or its services or any other user or enjoyment of this site, is strictly prohibited.

• Attempt to use or gain unauthorized access to data, accounts, hosts, servers, systems or networks of this site, or to probe, scan or test the

   vulnerability of a system or network of this site

• Interfere with service to any user, host or network including, without limitation, mail-bombing, flooding, or attempting to overload the system

• Forge any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting

• Falsify address information or otherwise modify e-mail headers to conceal the sender's or the recipient's identity

• Use this site or services for activities that violate any terms or conditions of any other network access provider or Internet service provider

• You may not, use any TACare service, upload, post, distribute or facilitate distribution of any content, including text, communications, software,

 images, sounds, data, or other information that, in TACare's discretion:

 ⅰ) Infringes the intellectual property rights of any entity or individual

 ⅱ) Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race,

   ethnicity, age, disability or any other reason

 ⅲ) Is posted in violation of a newsgroup charter

 ⅳ) Contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer

 ⅴ) Has a negative effect on TACare or its network (including, without limitation, overloading servers on TACare Network; causing portions of the

   TACare Network to be blocked by other network providers

 ⅵ) Constitutes unsolicited duplicative e-mail (commercial or otherwise)

SYSTEM AND NETWORK USAGE AND SECURITY

• Customers may not attempt to circumvent user authentication or security of any host, network, or account ("cracking"). This includes, but is not

 limited to, accessing data not intended for the Customer, password sniffing, security hole scanning, IP spoofing, logging into a server or account the

 Customer is not expressly authorized to access, or probing the security of other networks.

• Customers may not attempt to interfere with service to any user, host, or network ("denial of service attacks"). This includes, but is not limited to,

 "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.

• Customers may not use any kind of program/script/command, or send messages of any kind, designed to interfere with a user's terminal session, via

 any means, locally or by the Internet.

• Customers must safeguard their account passwords to prevent unauthorized access to their account.

• All accounts on Unmetered Bandwidth Packages may have their bandwidth being monitored from time to time to prevent any abuse on the network.

• Users who violate systems or network security may incur criminal or civil liability. TACare will cooperate fully with investigations of violations of

 systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal

 violations.

MATERIAL AND PRODUCT REQUIREMENT

• Customers must ensure that all material and data placed on TACare equipment is in a condition that is "server-ready," which is in a form requiring no

 additional manipulation on TACare part. We shall make no effort to validate this information for content, correctness or usability. In the event that

 the Customer's material is not "server-ready", we have the option at any time to reject this material. TACare will notify the Customer immediately of

 its refusal of the material and afford the Customer the opportunity to amend or modify the material to satisfy the needs and/or requirements of

 TACare.

• Uses of TACare facilities require a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies

 depending on the anticipated use of the facilities. Customers are responsible for having this level of expertise. It is not the responsibility of TACare to

 provide this knowledge or customer support outside of the service defined in the Service Agreement.

GENERAL USES

• Customers may not permit the use of mail services, mail-forwarding capabilities, POP accounts, or auto responders other than for the Customer's own

 account. Customers are also not allowed to sublet their account to others other than their own usage.

• Customers may not employ posts or programs that consume excessive CPU time or storage space. TACare reserves the right to kill CPU intensive

 process without prior notice or incurring of any liability.

• Customers may not host and stream video or audio files that consume excessive bandwidth usage. TACare reserves the right to suspend/terminate

 the account that abuse the server resources/bandwidth without prior notice or incurring of any liability.

• Customer may not use the hosting account for FTP Hosting or sharing of files via FTP that involve a lot of bandwidth usage. TACare reserves the rights

 to block any IP or FTP process without prior notice or incurring any liability, if any account is suspected of abusing their account for sharing of files via

 FTP for long period of time (> 30 mins)

• Customer may not host graphic intensive website or large file (>500MB) that generate huge amount of bandwidth. Hotlinking of image files are also

 strictly prohibited on all our servers. Large file hosting is strictly prohibited as it will consume huge amount of bandwidth. TACare reserve the rights to

 suspend any account that is caught hosting large files for users to download.

• Customer may not host game server on our network / server. TACare reserve the rights to suspend or terminate any account that is caught hosting

 such applications.

• TACare reserves the rights to terminate or suspend any account that is overloading the server without prior notice or incurring of any liability.

GENERAL CONDUCT

• TACare facilities may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of

 Republic of Singapore regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright,

 trademark, trade secret, or any other statute. TACare reserves the right to remove such illegal material from its servers.

• TACare facilities, any material that is, in TACare sole discretion, unlawful, threatening, abusive, libellous, or encourages conduct that would constitute a

 criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law, statute or regulation.

• The Customer is responsible for providing and maintaining accurate and up-to-date billing information. Furnishing false data on the signup form,

 contract, or online application, including fraudulent use of credit card numbers, is grounds for immediate termination, and may subject the offender

 to civil or criminal liability.

• Customers may not engage in tortuous conduct including, but not limited to, posting of defamatory, scandalous, or private information about a

 person without their consent, intentionally inflicting emotional distress, or making physical threats against another person via email, news, or any

 other electronic media/service we provide.

EMAIL

• Customers are bound by the TACare Spam Policy.

• Harassment, whether through language, frequency, or size of messages, is prohibited.

• Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.

• Malicious email, including but not limited to "mail bombing" (flooding a user or site with very large or numerous pieces of email) and "trolling" (posting

 outrageous messages to generate numerous responses) is prohibited.

• Forging of header or any other information is not permitted.

• Subscribing someone else to a mail list or removing someone else from a mail list without that person's permission is prohibited.

• TACare accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages

 violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.

• Customers may not use the Mail Server for Mass Mailing Activity (sending of mail to more than 20 recipients at any one time). TACare reserves the

 right to kill the mailing process without prior notice or incurring of any liability.

USENET - NEWSGROUP

• TACare is not responsible for the content of any newsgroup posting, whether or not a TACare Customer made the posting.

• Postings to newsgroups must comply with the written charters or FAQ for those newsgroups. Advertisements should only be posted in those

 newsgroups whose charters/FAQ explicitly permit them. The poster is responsible for determining the etiquette of a given newsgroup, prior to

 posting to it.

• Customers are prohibited from posting the same or similar message to large numbers of newsgroups (excessive cross-posting or multiple-posting,

 also known as "USENET Spam").

• Customers are prohibited from forging header information. This includes attempting to circumvent the approval process for posting to a moderated

 newsgroup.

• A customer may not solicit mail for any other address, other than that of the Customer's account or service, with the intent to harass or collect replies

 after TACare service has been terminated.

SPAMMING

This prohibition extends to

• The sending of unsolicited and/or mass e-mailings from any TACare account, or via another service which in any way

 ⅰ) Implicates the use of this site or TACare Services, TACare equipment or any TACare e-mail address;

 ⅱ) That is relayed from any TACare or third party's mail servers without permission;

 ⅲ) Employs techniques to hide the source of the e-mail;

 ⅳ) Which are sent, or caused to be sent, to or through the TACare Network that makes use of or contains invalid or forged headers, invalid or

  non-existent domain names or other means of deceptive addressing may be deemed to be counterfeit

• A communication may be unsolicited if:

 ⅰ) Recipients' email addresses were not obtained through a personal or customer relationship between recipient and sender,

 ⅱ) Recipients did not affirmatively consent to receive communications from sender, or

 ⅲ) Recipients have opted out of receiving communications from sender when given notice of the opportunity to do so.

• Senders should:

 ⅰ) Confirm that the actual owner of each email address, particularly email that are part of a list, agreed to receive email and/or bulk email from the

  sender;

 ⅱ) Include their email and/or physical address in any bulk mailings; and

 ⅲ) Provide recipients with an effective means of removing their email from lists.

Please Note: The transmission of unsolicited bulk e-mail, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender.

TACare reserves the right to take all legal and technical steps available to prevent unsolicited bulk e-mail or other unauthorized e-mail from being sent from or transmitted through the TACare Network, including the right, without prior notice, to perform vulnerability tests on systems residing on IP address space belonging to TACare which may be allocated for Customer use. The purpose of such testing includes, but is not limited to, testing of mail servers or proxy servers for unrestricted third party relaying. TACare will use commercial reasonable efforts to ensure that such testing will not adversely affect Service provided to Customer or compromise the security of Customer's network. Customer may be required to correct any system vulnerability upon notification and/or suspend or terminate operations of a known compromised system.

Your online communication or use of any TACare service is not edited, censored or controlled by TACare. TACare reserves the right to monitor content on this site and any TACare Services and to remove, disable, or suspend or terminate services if TACare, in its discretion, determines such content or user practices are harmful, offensive, or otherwise in violation of this Acceptable Use Policy.

END USERS

If Customer allows others (end users) to use the Service, Customer is responsible for ensuring that end users comply with this AUP. TACare may terminate Service if an end user violates this AUP. The Customer must also make contact information publicly available, and respond promptly to any complaints. Complaints regarding the Customer’s end users shall apply to the Customer.

File Sharing - The AUP, among other things, requires that you not illegally share copyrighted material over the TACare network, including through the use of e-mail, web pages, and peer-to-peer file sharing software. The unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may subject you civil and criminal liabilities.

Adult Content - TACare does not allow adult content in any way shape or form on all designated "shared" servers. Adult material can mean the following:-

ⅰ) Any site whose revenue is gained in part or whole from its adult content.

ⅱ) Photos or videos showing frontal nudity on either men or women for non-scientific or non-artistic purposes.

ⅲ) Hyperlinks to adult sites, including but not limited to sites who violate these policies.

ⅳ) Sites that have discussion boards and share information that is ‘adult’ in nature.

ⅴ) Sites that sell or promote ‘adult’ material, including but not limited to adult toys.

INTELLECTUAL PROPERTY VIOLATIONS

TACare prohibits any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities or activity that violates privacy, publicity, or other personal rights of others. TACare is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. TACare reserves the right to remove or block access to customer content upon receipt of notice of copyright infringement. Nothing on any TACare website shall be interpreted or implied in such a way as conferring any license or right to any intellectual property rights or license to any intellectual property, content, technology, system, process, or related material belonging to TACare by virtue of it being displayed or made accessible on any TACare website. Except as expressly authorized, you agree not to use this site or any TACare in any manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you may access, receive or make available through this site or any TACare Services. If you use a domain name or content in connection with the TACare web hosting, or any other web hosting service, you must not use that domain name or content in any way which violates any trademark, service mark, or similar rights of any third party.

INTERNET RELAY CHAT RULES

You must not run any Internet Relay Chat ("IRC") robot on any IRC server, IRC script or programs which might interfere with the Services or otherwise violate this AUP. When logged into any IRC server, you must comply with the rules and policies established by that IRC's service administrator.

PRIVACY

• TACare will not sell or knowingly disclose its customer lists or customer email address lists. We will attempt to protect the privacy of our Customers

 and their information that is stored on our network. TACare will only access and disclose information as necessary to comply with applicable laws and

 government orders, to operate and maintain our systems and services, or to protect ourselves or our Customers.

• TACare will not monitor or disclose a Customer's private email messages or other facility usage unless required by court order or law. We will

 cooperate with the authorities and will notify such authorities if it suspects that a Customer is engaged in illegal activities to the limit the law allows or

  requires, at TACare sole discretion.

• TACare will, from time to time, use our customer mailing lists for network updates, system information and general sales information. TACare may in

 the future limit all mailings to those clients who want to participate.

• For customer paying with credit card, the card information will NOT be held in the records of TACare. TACare do not hold or have access to the credit

 card information provided if the customer choose to pay by credit card during online registration.

• Customer passwords are confidential and will not be made available to any person or company outside of TACare for any reason whatsoever.

• All information will be stored as securely as possible while maintaining the ability for authorized TACare staff to quickly and effectively access this

 information when required operational purposes.

CONTROLLING LAW AND TERMINATION

This Authorized Use Policy is subject to, and shall be construed and enforced in accordance with the laws of Republic of Singapore without regard to its choice of law principles.

NOTICES

TACare Services (Asia) Pte Ltd Agreement and Acceptable Use Policy prohibit acts of copyright and trademark infringement and other unlawful behavior by TACare subscribers. TACare takes subscriber violations seriously and will investigate complaints and, where appropriate, may remove content, disable sites, suspend or terminate services, or take other action as necessary and assumes no responsibility for costs incurred for defending or asserting a violation of the Service Agreement or Acceptable Use Policy.

GENERAL COMPLAINTS

Please send reports of any activity in violation of this Acceptable Use Policy to intouch@tacare.com. TACare will reasonably investigate incidents involving such violations. TACare may involve and will cooperate with law enforcement officials if any criminal activity is suspected. Violations may result in criminal and civil liability.

COPYRIGHT/TRADEMARK INFRINGEMENT COMPLAINTS

If you believe that your copyright or trademark has been used by a TACare subscriber without permission, such that the use may constitute infringement of your intellectual property rights, please send a report to intouch@tacare.com.

FRAUD COMPLAINTS

TACare recognizes that acts of fraud can be and are committed over the Internet. TACare encourages all Customers and Internet users to be vigilant about protecting their personal information, account numbers, id's, passwords, etc. As with non-Internet fraud, fraud complaints are best and most appropriately made to law enforcement authorities. If you believe you have been the victim of Internet fraud (either via the web or through email), TACare encourages you to contact your local or state consumer protection authority, or government agencies that handle complaints about Internet fraud.

ACCEPTANCE OF POLICY

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS POLICY AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS POLICY
